In fight against Enhancement HUDA Plot Owners of Sector-52, Gurgaon gets the ball rolling.


In an endeavor to fight illegitimate enhancement levied by the HUDA in Sector-52, Gurgaon the HUDA plot owners and residents of Sector-52, Gurgaon got together and have finalised the counsel in the Hon’ble High Court of Punjab & Haryana at Chandigarh. Ld Counsel Sh A.S Tewatia has already helped residents of Sector-27 & Sector 28 Panchkula, Haryana in contesting HUDA enhancement and was instrumental in cutting enhancement by 52%.

With Sector-27, Gurgaon already getting interim relief from Hon’ble High Court in their case against their 1st enhancement, there are very bright prospects in the case of HUDA plot owners and residents of Sector-52, Gurgaon as there have faced 3 enhancements.

The following HUDA Plot owners/residents got together and initiated the process of contesting the monstrous enhancement.

Alternate HUDA Plot against disputed HUDA plots in Gurgaon by the end January



Plot Owners of HUDA Sectors 51, 52, 57 & other  falling in the jurisdiction of Estate Officer-2, HUDAwhose plots are under dispute finally get something to smile for as the HUDA proposes to give alternate plot against the disputed plots of Sector 51, 52, 57 & others by the end of January 2013. This is confirmed by the new article in the Times of India, dated 06th December 2012.


"For over 700 plot owners on disputed Haryana Urban Development Authority (HUDA) land, the agonizing wait for getting fresh allotment might be over by January next year.

Sorting out the cases of disputed plots has been a huge task for HUDA, officials said. The disputed plot owners had been fighting cases for more than seven years to get alternative plots by HUDA.

"So far over 300 disputed plots have been cleared and the owners have been allotted as per HUDA rules and regulations. Now in the next lot we are planning to clear over 700 plots," said HUDA, administrator, Praveen Kumar.

Earlier, because of paucity of the land and vacant plots, HUDA had been grappling with the allotment of the plots and this led to litigation in different courts.

Most of the plot owners were allotted plots and have paid substantial amounts to HUDA. The entire process of allotment went haywire after the landowners dragged HUDA to court and it became difficult to allot the plots. After the recent high court order HUDA has now swung into action and has expedited the allotment of the plots. HUDA has now worked out demarcation of all the vacant plots that are clear of any encumbrance.

The estate officer-II, Manoj Khatri, said: "Clearing of all the cases of owners of disputed plots has been the top priority and I am sure that all the cases in EO II range will be completed". Khatri has done all the spadework before clearing the disputed plot cases. The demarcation of all the vacant plots has been done in all the sectors now the next stage of action is seeking green light from the chief administrator's office. "The details of the plots on offer in different sectors will be sent to the chief administrator, HUDA, and then the allotment process will start, most likely in the first half of January," said Khatri.

As per the tentative plan, alternative plots will be offered in Sectors 33, 47, 49, 50 and 43. HUDA is also looking for records of other sectors, which have vacant or surrendered plots. Asked about the payment pattern for the plot, another senior HUDA official said: "The plot owners will not require to pay any extra money in case they have cleared all the dues. They will be given fresh allotment letters as per HUDA rules." The plot owners have welcomed HUDA's decision to clear all the pending allotments but they demand compensation for the delay.

"The delay in allotment has proved costly for all us as construction cost has shot up. I had got allotment in 2006 and the rise in construction cost has grown manifold now," said a plot owner, who did not want to be named.

HUDA issues Second Enhancement in HUDA Plots of Sectors 27,28, 42, 43 & first enhancement in Sector-57, Gurgaon

Haryana Urban Development Authority (HUDA) has served a severe blow to the residents and plot holders of Sector 27, 28, 42, 43 & 57 Gurgaon, Haryana. On 07.11.2012 HUDA issued 2nd Enhancement of hefty amount in Sector 27, 28, 42, 43 and first enhancement for Sector-57, Gurgaon. The Enhanced amount has to be paid till 31st December 2012. The details of enhancement are as under:-

Where as the residents & plot owners of HUDA Plots in Sector-57 were anticipating an enhancement since long but first enhancement by HUDA has gone way beyond the expected enhancement. Looking at the current trends where in Sector-51 & 52, Gurgaon has received 3 enhancements and Sectors 27,28, 42 &43 have got their 2nd enhancement, the  residents & plot owners of Sector-57, Gurgaon will have to remain under the hanging sword of 2nd & 3rd  enhancement by HUDA. 
However, now looking at the atrocious attitude of HUDA there is no other way left other than to approach the court of law, RWA of Sector 43 have already reached the Hon'ble High Court of Punjab & Haryana for relief. 

Since there are almost negligible numbers of residents living on the HUDA Plots so plot owners of the Sector-57 are finding it extremely difficult to get together. Problems in HUDA draw Sector-52, Gurgaon


Not everything is well in HUDA Gurgaon. 
This time also HUDA has proved that it is in state of total disarray. HUDA has been managing

Suspecting irregularities in the recent allotment of plots in Sector 52, the HUDA administrator, Praveen Kumar, has stalled the proceedings of 38 applicants.

HUDA had carried out the allotment process for 157 plots to applicants whose previous allotments had run into legal hassles. The allotment process took place on June 6.

Last week, HUDA officials dug out records and found discrepancies in the actual plots available and the plots allotted. Out of the 157 plots which were allotted, 38 had encroachments and should not have been included in the list of available plots.

Stumbling upon the goof, the HUDA administrator has now issued specific orders to freeze transactions of the 38 allotments and conduct a probe into the irregularities.

"This is a serious oversight which needs to be probed. It appears that the records of plots were tampered with and there was a deliberate attempt to include the plots which were not cleared for allotment," said Kumar.

HUDA has now decided that the possession of plots will not be given and no building plans will be cleared till the investigation gets over. All the records and files relating to the allotment have been seized.

As per policy, the Estate Office II should not have included the plots having encroachments but it did not happen and the residents were allotted such plots, said Kumar.

The detection of the discrepancies has saved HUDA from a major embarrassment and the possible litigation.

"If the allotment of the excess number of plots had gone unnoticed, then the plot owners would have dragged HUDA to court," said another HUDA official.

The departmental probe will also fix the responsibility of the officials for knowingly including the plots which had encroachments.

Plot holders of Sector-52, HUDA, Gurgaon, Haryana fail to take up fight against enhancement.


There seems to be a ray of hope for HUDA plot holders in Gurgaon who are seeking relief from atrocious enhancement levied by HUDA, Gurgaon. As the residents of Sector-27 & Sector-28, HUDA Panchkula, Haryana show them the way.

Residents of HUDA Sector-27 & Sector-28, Panchkula, Haryana were imposed with similar enhancements of Rs.3098.16 per Sq.yd & Rs.4646.49 per sq.yd and they sensed that the enhancement imposed upon then was grossly non maintainable.

Residents of Sector-27 & Sector-28, HUDA Panchkula, Haryana got together and filed their case against HUDA for non maintainable enhancement in the Hon’ble High Court of Punjab & Haryana at Chandigarh through their Ld Counsel Sh A.S Tewatia, who as a through professional attained speaking order for HUDA Administrator to form a committee and report within 2 months.

On this a committee was formed and HUDA issued  No.HUDA-CCF-Acctt-II-2012/11347-48, dated 28/3/2012 for Sector-27, Panchkula, Haryana & No.HUDA-CCF-Acctt-II-2012/11349, dated 28/3/2012 for Sector-28, Panchkula, Haryana where in HUDA officially retracted and said that the recovery rate for Sector-27, Panchkula, Haryana has been worked out to Rs.1903.76 per sq.yd against the previous recovery rate of Rs.3098.16 per Sq.yd. and for Sector-28, Panchkula, Haryana recovery rate has been worked out to Rs.2495.34 per sq.yd against the previous recovery rate of Rs.4646.49 per sq.yd for general category

Now in January 2012 HUDA, Gurgaon  issued orders imposing the enhanced cost for Sector-27, 28, 42,43, 51 & 52 Gurgaon as under:-

Since the Sector-27, 28, 42 & 43 have fair number of residents and they have taken up their fight against the enhancement to courts at their own level and it seems that they will get justice soon.

Sector-51 & 52 has faced the maximum brunt of enhancement as it is facing 3rd enhancement where as other sectors are having their 1st enhancement. Despite loosing precious money the residents of Sector-51 & 52 seems to be losing the fight as it does not have much residents living in these 2 sectors.

An effort was made few months back to form a forum by the residents of Sector-52 but nothing could be achieved. Now a fresh endour has been made same counsel Sh A.S Tewatia (who got the relief for the residents of Sector-27 & 28, HUDA, Panchkula, Haryana) has been finalised.

It is further clarified that only those whose name features in petition will be benefited by the Court’s relief because HUDA does not provide blanket relief (HUDA has extended relief in Panchkula to only those whose name were in petition)

It is the only time where in you can be a part of petition and save your hard earned money.

It is intimated that in compliance of the orders of Hon’ble Punjab and Haryana High Court in CWP No.18681/2011 (O&M) the representation from Joint Action Committee of Sector 25 to 28, Panchkula was received against the recovery of enhancement of sector-27, Panchkula. The representation of the Joint Action Committee was examined and meetings were also held with the representative of Joint Action Committee. The Joint Action Committee intimated that there is difference in the area and amount paid to land owners on which the enhanced compensation had been worked out then the area existed at site. The STP, HUDA and DTP, Panchkula, were asked to verify the actual area. LAO, Panchkula and Sr.A.O., Panchkula O/o Administrator, HUDA, Panchkula were asked to reconcile the payments. After reconciliation the detail of area and payments by CTP/DTP and LAO/Sr.A.O., Panchkula, it was decided to make the corrections in the rate of recovery of enhanced compensation on the basis of actual area, actual payments detail and speaking order passed in compliance of the order of Hon’ble Punjab and Haryana High Court in CWP No.18681/2011 (O&M).

Accordingly the recovery rate has been worked out to Rs.1903.76 per sq.yd against the previous recovery rate of Rs.3098.16 per Sq.yd. for general category in respect of Sector-27, Panchkula.

This recovery will be affected from the date of issue of original notice with the following stipulations:-
(i)     The allottees who have paid the extra amount due to decrease in the rate of recovery will beallowed interest @15% p.a. on the excess amount paid by them. 
(ii)    The allottees who have not paid/ partly paid of enhanced compensation, the amount will be charged the interest @15% per annum on the revised rates from the date of issue of original notice.

On the basis of further payments made to the land owners by the LAO, Panchkula, the second recovery rate of enhanced compensation works out to Rs.162.33 per Sq.yd. for General category. The recovery of which notices may be issued within 15 days. The extra amount paid by the allottees of 1st enhancement along with the interest may be adjusted against the 2nd enhancement and excess amount, if found, thereafter may be refunded.

You are, therefore, requested to issue the revise notices of recovery of 1st enhancement and issue the notices of 2nd  enhancement as per above decision. The copy of revised calculation of 1st enhancement and copy of 2nd enhancement are enclosed herewith. Any amount of enhancement compensation paid thereafter will be recoverable from the allottees.

HUDA draw of Plots in Sector-52, Gurgaon



Haryana Urban Development Authority (HUDA), Gurgaon in a major development brought a sigh of relief to some of the plot holders in Sector-52, Gurgaon. Today i.e on 08/06/2012 HUDA organised a public draw for owners of plots in Sector-52., Gurgaon who were deprived of possession of the plots because of litigations and omissions by HUDA. HUDA Administrator Praveen Kumar in his presence held the draw. Most of owners who either moved to Hon’ble High Court of Pujab & Haryana or other courts got their plots included in draw; those who failed to get directions from court are still deprived of plot. However HUDA Administrator Praveen Kumar verbally assured the public at large that those who missed the draw will be accommodated in other locations of Sector-52 or Sector-51. Sohna Road: Next Commercial Hub


Since last 8 years DLF Cyber City, MG Road & Golf Course Road has remained a prime destination for MNC’s and corporate houses to set up their businesses in Gurgaon. Proximity to Delhi and International airport was the main reason that these place flourished. DLF & Sushant Lok catered the residential solution to the employees of these MNC’s and corporate.
The existence of so many commercial buildings on Golf Course and surrounding area resulted in huge rise in residential buildings. Now the rates have soared up to Rs 20K per sqft in premium housing like Aralia, Pinnacle, Laburnum etc and Rs 15k-12k per sqft in Sahara Grace, Summit, Pinnacle etc.
Now the MNCs and corporate are exploring new destination within Gurgaon i.e Sohna Road. Sohna Road provides good options of commercial building (see list at bottom) with very low rental rates as compared to Golf Course Road. A office in well maintained commercial buildings in Sohna Road can be acquired at the rental rate of Rs 35-45 per sqft where as same space in DLF Cyber City, MG Road & Golf Course Road comes at Rs 100-120 per sqft.

Companies clearly are cutting cost by opting for Sohna Road. Sohna Road has quick access from NH-8 and almost takes equal time to reach any office in DLF Cyber City, MG Road & Golf Course Road as there is heavy traffic congestion in these areas.

Sohna Road also provides decent and affordable residential options as compared to expensive DLF & Sushant Lok areas. There are many existing townships on Sohna Road like Vatika City, Park View City 1&2, Orchid Petals etc . Sohna Road again has a quick linkage to Golf Course Road by 90 meters vide Golf Course Extension Road. Metro is also proposed to connect Sohna Road to other operational Metro routes.
Moreover the upcoming projects of IREO, M3M, TATA, EMAAR etc on Golf Course Extension Road will add market value of Sohna Road.
In coming days the Sohna Road is bound to be a successful landing place for multinational companies. It will be a good decision to INVEST in Sohna Road and surrounding areas.
