Filing of TDS on purchase immovable property made easy

The Central Board of Direct Taxes (CBDT) has notified the new provision under section 194IA, wherein after 01.06.2013 1% Tax Deducted at Source(TDS) has to be levied on sale/transfer of  immovable property (other than rural agricultural land) exceeding  Rs 50 lakhs. Buyer of the property is required to deduct the 1% TDS before making the payment to the seller.  
Since this tax is new and not everyone is well versed with the concept. There is confusion amongst the property buyers and sellers, we have tried to answer most of the queries in the simplest of the way.

Who will deposit this tax?

This tax has to be deposited by the buyer on behalf of the seller and after the registration/transfer/allotment buyer gives seller certificate 16B (16B is certificate given by buyer certifying that the 1% TDS has been deposited in government treasury on sellers behalf).

What if property is bought on lump sum or in  installments?

If property is bought on lump sum basis then 1% of the total sale consideration has to be deposited as TDS.
If the property is bought on installments or bought in construction link plan then 1% TDS has to deducted and deposited if the cumulative value of the property is more than Rs 50 lakhs. Buyer has to deposit 1% as TDS in each installment.

How to deposit?         
This is the question that troubles most of the buyers, but it is very easy and can be done at ease. It will just few minutes if buyer has net banking facility and for those who don't have net banking then process becomes bit lengthy but remains easy.

For those who have net banking.
  • Those buyers with net banking can open  Form 26QB (Form to file TDS on property).
  • Before filling the form buyer must have Pancard Number of both buyer and seller.
  • Buyer must have the correct address of the property purchased and  complete residential addresses of buyer and seller.
  • Click Here and select Form 26QB and start filling up the requisite information.
  • Once you fill the form it will ask you to confirm the details (this is important).
  •  After confirmation 9 digit acknowledgment number will be allocated to you.
  •  Then you will be asked to proceed for payment.
  •  Select your bank and make payment
·       Once your payment is done you will receive Challan Identification number (CIN). This CIN is the proof that buyer has made the payment of TDS on behalf of seller. This CIN Number is required to mentioned in registry/transfer documents.

For those who don't have net banking facility.

If the buyer does not have net banking facility then it is advised to get net banking facility activated, it takes a week's time to get this service activated. In case net banking con not be activated then follow these steps.
  • Click Here and select Form 26QB and start filling up the requisite information.
  • Once you fill the form it will ask you to confirm the details (this is important).
  • After confirmation 9 digit acknowledgment number will be allocated to you.
  •  Take 3 prints of acknowledgment.
  • Contact the bank (Click here to see Income Tax approvedbanks)
  • Please note not all banks accept TDS/Challan. Enquire about  such branch.
  • Deposit money in cash or cheque in  selected bank. 
  • Bank must deposit TDS by its net banking account.


·         Once your payment is done you will receive Challan Identification number (CIN). This CIN is the proof that buyer has made the payment of TDS on behalf of seller. This CIN Number is required to mentioned in registry/transfer documents.

What after the Challan Identification number (CIN) is issued?

Once the CIN is issued then buyer can proceed with final transaction i.e. transfer or registration. After this buyer is required to sign and give 16B certificate (Certificate of TDS deduction) to seller for his Income Tax return and related purposes.
Form 16B will be available for download from the website of Centralized Processing Cell of TDS (CPC-TDS) www.tdscpc.gov.in

In a major relief to the plot owners of Sector-57, Gurgaon, HUDA has cleared huge number of plots which were earlier part of disputed plots.

Deadline for the proposed draw of disputed HUDA Plots in Gurgaon to be extended

In the recent development in Gurgaon, HUDA has cleared 382 plots in Sector-57 from encroachment and HUDA says that cleared plots will be given to the allotted in coming days.
Because of this the draw of disputed plots in Sectors 51, 52, 57 etc which was to be held before 8th December as per the directions on Hon'ble High Court of Punjab & Haryana. This clearance of HUDA plots in Sector-57 has delayed the process as new list will have to be prepared.
As of now it can be said that ambiguity of draw still persists.

Plot Owners of Sector-52, Gurgaon file contempt of court case against Chief Administrator HUDA for enhancement issue.

Hon'ble High Court of Punjab & Haryana on 30.01.2013 in CWP 1939 of 2013 (filed by HUDA Plot owners of Sector-52, Gurgaon under their association Progressive Citizen Welfare Association, Sector 52, Gurgaon) had directed HUDA to address the issue of enhancement of plot's cost and expedite the matter by involving the plot owners. Plot owners of Sector 52, Gurgaon waited for good 8 months but HUDA did not paid any heeds to the grievance of the ordinary citizens and after seeing that HUDA is not bothered at all decided to file Contempt of Hon'ble Courts Order against the Chief Administrator, HUDA, Panchkula, Haryana. 

The Contempt of Court Case vide COCP 2669 of 2013, was filed in Hon'ble High Court of Punjab & Haryana on 09.010.2013 against Sh A.K Singh, Chief Administrator HUDA, Panchkula, Haryana. Next date is fixed for 01.04.2014. Plot owners are now hopeful that HUDA will pull up their socks and do all efforts to save their Chief Administrator Sh A.K Singh from ire of Hon'ble High Court Judges.
The hope and belief of getting relief from erroneous, atrocious, escalated and non maintainable enhancement cost levied on the plot owners of Sector 52, Gurgaon. 

Till date the plot owners of the following plots are the members of Progressive Citizen Welfare Association, Sector 52, Gurgaon.
26, 27, 46, 125, 131-P, 438, 503, 509, 515, 554, 555, 556, 582, 585-P, 587, 628-C, 659-P, 661-P, 695, 706, 710, 736-P, 1082 E, 1083 F, 1244, 1247, 1249-P, 1257, 1263-P, 1318, 1387, 1413-P, 1463, 1708, 1790-P, 1867-P and many other plot owners have pledged their support in the cause which affects every plot owner of Sector-52. 

Moreover, many plot owners are under the belief that once any relief is extended to petitioners by HUDA then it would have common effect on every plot, just to remind those who think on these lines are mistaken because HUDA and others generally grant relief to the petitioners only. 

Since, the land owners of village Wazirabad onto whose land this Sector 52 is carved out  are already in Supreme Court, it is expected that another news of 4th enhancement may come with morning newspaper any day. 

So, it would be better for the plot owners to join hands with Progressive Citizen Welfare Association, Sector 52, Gurgaon and contest current and future enhancement and similar pertaining to Sector 52, HUDA, Gurgaon.

Appeal to all plot owners & CGHS Flats owners of HUDA Sectors 27, 28, 42, 43, 51, 52 & 57 of Gurgaon.

It has been very long since the residents, owners of Plots and Group Housing apartment in  HUDA Sectors 27, 28, 42, 43, 51, 52 & 57 have been raising issue of Enhancement with HUDA and High Court of Punjab & Haryana. 

HUDA has been directed by Hon'ble High Court in various petitions filed by the affected sectors to listen the concerns raised by owners of plots and flats and expeditiously resolve the issue. HUDA despite of speaking order from High Court orders have turned deaf ears. HUDA and the administration knows that most of the owners are not residents and they will never be able to get together, so it is easier for administration to ignore the common people.

Now the time has come for all of us to get united and raise the issue with the government, when we will show our numbers they will not be able to ignore us. It pretty evident that government and its administration are not bothered with our logical and genuine concerns pertaining to enhancement. 

Knowing this that we don't have voice and existence as citizen but it is high time for all of us as the parliamentary elections are around. We have votes which is the only thing these governments are interested. 

I appeal to all residents, owners of Plots, CGHS apartments & RWAs in  HUDA Sectors 27, 28, 42, 43, 51, 52 & 57 to join hands and fight atrocious enhancement. 

Please reply and show solidarity to the issue of non maintainable enhancement cost incurred by HUDA on us. It is our hard earned money which HUDA and Haryana Government have extorted and further wish to extort in the name of enhancement. Haryana government & HUDA are making us pay for their inefficiency and callous attitude in resolving the issues of local farmers while acquiring their farm lands.

Finally, I as one of the plot owner appeal to all affected people to get together and take this fight to next and decisive level.

Stay on the draw for alternate plots in lieu of disputed plots in Sector 27, 28, 42,43, 51, 52, 57 etc VACATED

Plot owners who had plot on papers only will own plot for real. Hon'ble High Court of Punjab & Haryana on 08/08/2013 vacated the stay on the draw for alternate plots in lieu of disputed plots in Sector 27, 28, 42,43, 51, 52, 57 etc

HUDA has been directed to conduct draw with 4 months.

Plot owners to whom the plot has not been handed over on any pretext, be it litigation, encroachment or other wise are advised to check with HUDA whether their plot is in list of disputed plots made by HUDA, if not then owner should pursue and get his/her plot included the list of disputed plots which are to be considered for draw of alternate plots.

Stay on HUDA draw of disputed plots in Sectors 38, 39, 51, 52, 57 of Gurgaon might be vacated on 02.08.2013

On 26.07.2013 Hon'ble High Court of Punjab & Haryana heard the reply filed by the HUDA pertaining to the draw of disputed HUDA plots in Sectors 38, 39, 51, 52, 57 of Gurgaon. In reply HUDA has said that they have accommodated those plot owners whose plots were not included the list of disputed plots which are to be considered for re-allotment.

Petitioners have seeked a week time to go through the HUDA's reply. Now it seems that the probability of stay to be vacated on the HUDA draw has increased. Rest will be confirmed when the case comes up for hearing on next date 02.08.2013.

Draw of disputed HUDA plots finds itself in dispute. Next date in Court is 20.05.2013

When you are with HUDA, you can never be relaxed....

For those who felt that they are the owners of plot in Gurgaon and feel they own an asset... HUDA is there to shatter all your dreams.

HUDA with pride announced that they are going to settle the issue of disputed plots in Sector-51,52, 57 and other sectors by allotting them new plots in different sectors on 13.02.2013. This announcement brought a ray of hope for those had the privilege of being called the owner but didn't had any plot to make a house.

HUDA Gurgaon stood by it's standard of non performance, their so called civil servants like Estate Officer, Administrator etc are just busy flashing their red & blue beacons and had no time for ground work required for the draw of disputed plots in Gurgaon. It has been seen that since the alottment of the plots HUDA has shown no intent of resolving the problems of public at large. 
The basic agenda from Peon to Administrator has been to successfully complete their tenure in HUDA Gurgaon and welfare features nowhere in there agenda.

Problem in draw: The number of plot holder whose plots were included in disputed list prepared by HUDA is much less than actual disputed plots. HUDA Gurgaon included plots in disputed list which were either given by court's directions or got through influence (which works faster than any court). Now those whose name were not included in disputed list went to court against this draw and Hon'ble High Court understood the inefficiency of HUDA and stayed this flawed draw. 
Now next date to decide the draw in the Hon'ble High Court is fixed 20th May 2013.

High Court stays the proposed HUDA draw of disputed plots in Gurgaon till 12th March 2013

On expected lines the Haryana Urban Development Authority (HUDA) stood by its reputation of messing up things. HUDA Gurgaon made lots of claims of sorting out the problems of disputed HUDA plots in Gurgaon and decided to hold the draw on 13th Feb 2013. HUDA claimed to resolve the issues of 730 plot holders and proposed to allot them new plots in different sectors.

HUDA in this process failed to include many of the plot holders in the disputed list which were to be allotted new plots. On being ignored by HUDA the plot owners were left with no choice but to approach Hon'ble High Court of Haryana & Punjab. High Court on hearing plea of the ignored plot owners stayed the draw of disputed HUDA plots to 12 March 2013.

High Court orders HUDA to reslove the issue of HUDA Plots enhancement of Sector-52, Gurgaon

In a recent development plot owners & residents of HUDA Plots in Sector-52, Gurgaon, Haryana under the the name of " Progressive Citizen Welfare Association, Sector-52, Gurgaon" filed petition against the HUDA Enhancement in HUDA Plots Sector-52, Gurgaon.
On 30.01.2013 the petition was heard by the Double Bench comprising of Hon'ble Justices Sh Satish Kumar Mittal & Sh Amol Rattan Singh at High Court of Punjab & Haryana at Chandigarh where HUDA was ordered to address the concerns expeditiously on the lines on the judgement passed in the matter of Enhancement of Sector-27 on 23.11.2012.

These orders brings ray of hope for the members of the "Progressive Citizen Welfare Association, Sector-52, Gurgaon" which has been trying to contest the issue of enhancement since long.
