Problems don't end for the Plot Owners of Sector-57, Gurugram. More than 1000 plots fall into court stay & omission

Once again non-application of mind and careless, the attitude of HSVP which was earlier known as HUDA has exacerbated the never-ending woes of residents and plot owners of Sector-57, Gurugram.

Sector-57, Gurugram is still reeling under the atrocious enhancement and matter is still unresolved, despite several assurances for the HSVP and worthy Chief Minister Sh Manohar Lal himself, now this sword of ambiguity in the name of stay on plots hangs plot owners and residents.

The HSVP says that more than 1000 plots of Sector-57, Gurugram fell into the category of being omitted or bears the status of court stay. HSVP says that landowners on whose land these plots have been carved out, have approached Hon'ble High Court & Hon'ble Supreme Court for the release of their lands under the provisions of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The matter is either pending in either of the above mentioned courts.

It is difficult to understand when landowners went in court for relief in the years 2014 and after, then why HUDA/HSVP allowed the sale purchase and construction of these plots, these developments were not told to the plot owners, who are equal stakeholders in this development.

What does this stay means?
This stay means that no transfer permissions for sale of plots, no completion certificates after the construction of the house etc would be given by the HSVP.

How this would be resolved?
Until HUDA/HSVP appeals or makes prayer in courts where matters are pending saying that 3rd party interest is also being created and someone else other than Land Owner and HUDA/HSVP is also affected because of this stay imposed by HSVP citing court orders.

Those who are immediately affected by this stay and who are denied the sale or purchase and those who are unable to get completion certificate etc should make a representation to HSVP and later will have to approach the concerned court for seeking relief.

Result of HUDA draw for alternate plots in Gurgaon held on 17th, 18th, 19th, 20th & 21st of February 2014

HUDA held draw for the disputed plots as per schedule on 17th, 18th, 19th, 20th & 21st of February 2014 at HUDA's Sector-56, office in the presence of HUDA Administrator.

This draw brought happiness to some people who were waiting for alternate plots since long whereas many of the plot owners felt cheated as HUDA allotted them plots inferior locations and  much under developed pockets of Sector-57 etc.

Many of the plot owners are planning to challenge their alternate allotments in this draw, as they had bought their plots in resale after analyzing the location and fresh allotments are nowhere in comparison to their plots.

Those owners who missed the draw can know the details of allotment by sending the following information at pankaj@easyghar.com

Deadline for the proposed draw of disputed HUDA Plots in Gurgaon to be extended

In the recent development in Gurgaon, HUDA has cleared 382 plots in Sector-57 from encroachment and HUDA says that cleared plots will be given to the allotted in coming days.
Because of this the draw of disputed plots in Sectors 51, 52, 57 etc which was to be held before 8th December as per the directions on Hon'ble High Court of Punjab & Haryana. This clearance of HUDA plots in Sector-57 has delayed the process as new list will have to be prepared.
As of now it can be said that ambiguity of draw still persists.

Appeal to all plot owners & CGHS Flats owners of HUDA Sectors 27, 28, 42, 43, 51, 52 & 57 of Gurgaon.

It has been very long since the residents, owners of Plots and Group Housing apartment in  HUDA Sectors 27, 28, 42, 43, 51, 52 & 57 have been raising issue of Enhancement with HUDA and High Court of Punjab & Haryana.

HUDA has been directed by Hon'ble High Court in various petitions filed by the affected sectors to listen the concerns raised by owners of plots and flats and expeditiously resolve the issue. HUDA despite of speaking order from High Court orders have turned deaf ears. HUDA and the administration knows that most of the owners are not residents and they will never be able to get together, so it is easier for administration to ignore the common people.

Now the time has come for all of us to get united and raise the issue with the government, when we will show our numbers they will not be able to ignore us. It pretty evident that government and its administration are not bothered with our logical and genuine concerns pertaining to enhancement.

Knowing this that we don't have voice and existence as citizen but it is high time for all of us as the parliamentary elections are around. We have votes which is the only thing these governments are interested.

I appeal to all residents, owners of Plots, CGHS apartments & RWAs in  HUDA Sectors 27, 28, 42, 43, 51, 52 & 57 to join hands and fight atrocious enhancement.

Please reply and show solidarity to the issue of non maintainable enhancement cost incurred by HUDA on us. It is our hard earned money which HUDA and Haryana Government have extorted and further wish to extort in the name of enhancement. Haryana government & HUDA are making us pay for their inefficiency and callous attitude in resolving the issues of local farmers while acquiring their farm lands.

Finally, I as one of the plot owner appeal to all affected people to get together and take this fight to next and decisive level.

Jai Hind....

On 26.07.2013 Hon'ble High Court of Punjab & Haryana heard the reply filed by the HUDA pertaining to the draw of disputed HUDA plots in Sectors 38, 39, 51, 52, 57 of Gurgaon.
